Terms of service

These terms are the agreement between you and TopThree AI [PLACEHOLDER: legal entity name] ("TopThree", "we", "us") for using this site and the TopThree AI service. By running a check, creating an account or buying a plan, you agree to them. If you use TopThree for a business, you confirm you're allowed to accept these terms for it.

You must be at least 18 to buy a plan.

01What TopThree does

TopThree asks an AI engine questions that customers ask about local businesses, and shows you:

• the exact prompts we sent and the raw answers we got back,
• which businesses were named, and whether yours was,
• which engine answered and when, and
• if you give a website, a separate AI-readiness audit of its public pages.

Paid plans add weekly re-checks and history (Monitor and Pro) and a Fix Pack of files and copy for you to publish (Fix Pack). Plan details and limits are on the pricing section and may change as described in section 11.

02No promise about what AI says

AI assistants decide their own answers. We don't control them, and nobody can promise what they'll say.

• AI answers vary from run to run, from engine to engine, and over time. A result is a record of what one engine said when we asked, not a permanent fact.
• The engine we used is named on every result. Answers from an API can differ from what the same company's consumer app shows a person.
• We don't promise that any AI assistant, AI search feature or search engine will recommend, rank, cite or mention your business, before or after you use a Fix Pack.
• The AI-readiness audit checks things answer engines can read on your site. A higher score is not a promise of more recommendations.

03The Fix Pack: files you publish yourself

• The Fix Pack is a set of files and draft copy generated from your latest check, your audit and the details you give us in the intake form.
• You publish everything yourself, or your developer does. We never access, log in to, edit or post to your website, CMS, Google Business Profile, directory listings, review sites or social accounts, and we never ask for your passwords.
• Drafts are drafts. Check every fact, price, address, phone number, hour and claim before you publish. You are responsible for what you publish and for making sure it is accurate and lawful.
• Delivery is a download in your dashboard (and an email link once email sending is on). A free re-check after you publish is included.

04Subscriptions, billing and cancelling

• Monitor (US$79/mo) and Pro (US$199/mo) are monthly subscriptions. The Fix Pack (US$299) is a one-off purchase. Prices are in US dollars. Taxes may be added where they apply. [FOUNDER CONFIRM]
• Payments are processed by Stripe. Subscriptions renew automatically each month on the same date until you cancel.
• Cancel any time from the Stripe billing portal linked in your dashboard. You keep access until the end of the period you've paid for, and you won't be charged again.
• If a payment fails, Stripe may retry it. If it still fails, we may pause paid features until it's resolved.
• We'll give you at least 30 days' notice by email before changing the price of a plan you're on. [FOUNDER CONFIRM] The new price applies from your next billing date after that notice. You can cancel before then.

05Refunds

Any Fix Pack refund is about the files, never about what an AI assistant says afterwards.

We'll publish our refund policy here once it is set. Until then, we don't offer refunds except where the law requires them.

Nothing in these terms limits rights you have under consumer law that can't be excluded, including the Australian Consumer Law where it applies. [FOUNDER VERIFY legal]

06Acceptable use

Don't use TopThree to:

• run automated, scripted or bulk checks, or get around bot protection, rate limits, plan limits or the daily check budget;
• check businesses or people in order to harass, threaten, stalk or defame anyone;
• check private or internal addresses, or try to make our audit fetch anything other than public web pages;
• scrape, copy or resell our pages, results or "who AI recommends" data at scale;
• misrepresent results, for example by editing a share image or badge, presenting an old result as current, claiming an AI "recommends" you when the stored result doesn't show it, or implying any business endorses you or us;
• break the law, infringe anyone's rights, or interfere with the service or other users.

We may limit, suspend or close an account or block access that breaks these rules. Where it's reasonable, we'll tell you why first.

07Your content and results

• You keep any rights you have in what you give us (business details, intake answers). You let us use it to run the service for you.
• You may use your own results, share images and Fix Pack files for your business, including publishing the Fix Pack on your own site.
• Share pages are created only when you tap Share, and you can delete them at any time.
• We may use check results in aggregate, without your email, to improve the service. Answers to general questions that don't name your business (such as "best plumber in Austin") may appear on our "who AI recommends" pages (section 8), without saying who ran the check. 08Who AI recommends pages and corrections

Our public pages under /ai-recommends/ show what an AI engine answered to general questions (for example "best plumber in Austin"), with the engine, date and method. They report the engine's answers. They are not our reviews, ratings or opinions of the businesses named, and being named, or not named, doesn't mean any business endorses or is endorsed by TopThree.

If a page is wrong about your business, or you want your business removed, use "Request a correction or removal" on the page or send a correction request. We review every request. [FOUNDER CONFIRM: response time]

09Our intellectual property

TopThree AI, the TopThree name and logo, the site, the software and our page designs belong to us. These terms don't give you any right to use our name or logo, except to link to us or to use the official badge as offered in the product, without changing it. Competitor names that appear on our site are used only to identify those companies.

AI answers shown in TopThree are generated by third-party engines. We don't claim ownership of them, and we show them as quotes.

10Disclaimers and limits of liability

• TopThree is provided "as is" and "as available". We work to keep it accurate and running, but we don't promise it will be error-free or always available, or that any result or file will produce a particular outcome for your business.
• To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits, lost revenue, lost customers or lost data, or for what any AI engine, search engine or third party says or does.
• To the extent the law allows, our total liability for any claim about the service is limited to the amount you paid us in the 12 months before the claim. [FOUNDER VERIFY legal]
• Some laws don't allow these limits. Where that's the case, they apply only as far as the law permits.

11Changes to the service and these terms

We may change features, limits or these terms. If a change materially reduces what you get on a paid plan or materially changes these terms, we'll tell you by email at least 30 days before it takes effect [FOUNDER CONFIRM], and you can cancel before then. Using TopThree after a change takes effect means you accept it.

12Ending the agreement

You can stop using TopThree and cancel your subscription at any time. You can also ask us to delete your account and data (see the privacy policy). We may end these terms if you seriously or repeatedly break them, or if we stop offering the service, in which case we'll give reasonable notice and refund any prepaid period you couldn't use.

13Governing law
